1. These Services

We are Her Travel Circle Ltd, a company incorporated and registered in England with company number 17276090 whose registered office is at Carpenter Court 1 Maple Road, Bramhall, Stockport, Cheshire, United Kingdom, SK7 2DH ("Her Travel Circle", "we", "us" or "our").

2. This Assumption of Risk, Liability Notice and Release

2.1 This assumption of risk, liability notice and release (our "Notice and Release") applies to the use of our Services.

2.2 This Notice and Release should be read in conjunction with our Terms of Use located at https://www.hertravelcircle.com/terms-of-service, our Privacy Policy located at https://www.hertravelcircle.com/privacy-policy, and our Cookie Policy located at https://www.hertravelcircle.com/cookie-policy, all of which together form the agreement between you and us relating to your access of and use of the Services.

2.3 By accessing or using the Services, registering as a Member, arranging or participating in an Experience, acting as a Host, acting as a Traveller, or acting as a Local Connection you acknowledge and agree to the terms of this document. If you do not agree to this document, you must not use the Services or arrange or participate in any Experience through the Services.

3. Our role

3.1 We are a membership platform, facilitating the arrangement of the Experiences via the Services between Members. The details of the Members providing Experiences are disclosed as part of our Services where Experiences are made available.

3.2 All Member Contracts are made between Members. We do not:

3.2.1 own, provide, manage, control, inspect or operate any accommodation or other property made available by a Host;

3.2.2 organise, supervise, manage, control or deliver any Experience;

3.2.3 act as a travel agent, tour operator, package travel organiser, accommodation provider, broker, insurer, trustee or fiduciary for any Member;

3.2.4 employ, appoint or supervise any Member;

3.2.5 guarantee the conduct, suitability, accuracy, safety, legality or reliability of any Member, accommodation, listing, communication, Experience or Member Contract; or

3.2.6 become a party to any Member Contract.

3.3 The relevant Host, Traveller and Local Connection are responsible for agreeing the terms of any Member Contract between themselves. Any claim, complaint, dispute or issue arising out of or in connection with a Member Contract must be raised with the relevant Member, not with us, unless the claim relates to our own breach of duty or breach of our Terms of Use.

3.4 Nothing in this document is intended to exclude, restrict or alter any responsibility which Her Travel Circle may have under applicable law where that responsibility cannot lawfully be excluded, restricted or altered.

4. Independence of Member Contracts

4.1 You acknowledge that Experiences are arranged between Members independently.

4.2 You are responsible for deciding whether to enter into, continue with, cancel or vary any arrangement (including any Member Contract) with another Member.

4.3 You are responsible for making your own enquiries before entering into any Member Contract, including enquiries about:

4.3.1 the identity, background, suitability and reliability of the other Member;

4.3.2 the location, condition, safety, suitability, accessibility and legality of any accommodation;

4.3.3 travel requirements, visas, entry requirements, health requirements and local laws;

4.3.4 payment arrangements, cancellation arrangements, house rules and any other terms agreed with another Member;

4.3.5 insurance arrangements; and

4.3.6 any risks which may affect your decision to host, travel, stay, meet or interact with another Member.

4.4 We do not review, rate, moderate or manage any aspect of Experiences.

5. Assumption of risk

5.1 You acknowledge that participating in travel, arranging accommodation, meeting other people, hosting other people, staying in private accommodation, and participating in Experiences involves inherent risks, which may include risks of:

5.1.1 personal injury, illness, accident or death;

5.1.2 loss, theft or damage to property or belongings;

5.1.3 cancellation, delay, non-attendance or changes to travel or accommodation arrangements;

5.1.4 inaccurate, incomplete or misleading information provided by another Member;

5.1.5 unsafe, unsuitable, inaccessible or unlawful accommodation;

5.1.6 misconduct, negligence, criminal conduct or other acts or omissions of another Member or third party;

5.1.7 disputes about payment, deposits, damage, refunds, cancellation, standard of accommodation, behaviour or other matters;

5.1.8 legal, regulatory, immigration, tax, licensing, planning, health and safety, housing, short-term letting regulation non-compliance or other non-compliance;

5.1.9 unexpected occurrences associated with travel, unfamiliar locations, local transport, weather, public health issues, epidemics, pandemics, civil unrest or other circumstances; and

5.1.10 of the nature normally associated with travel, hosting, accommodation sharing or meeting people through an online platform.

5.2 You voluntarily accept the risks associated with your use of the Services, your interaction with other Members, and your decision to arrange, host, attend or participate in any Experience.

5.3 You remain responsible for your own decisions, safety, property, conduct and compliance with law.

6. Traveller responsibilities

6.1 If you are a Traveller, you are responsible for:

6.1.1 assessing whether a Host, Local Connection accommodation and Experience are suitable for you;

6.1.2 communicating any relevant requirements to the Host or Local Connection before entering into any Member Contract;

6.1.3 reviewing and considering Member Contracts before agreeing to them;

6.1.4 checking travel documents, passport requirements, visas, entry requirements, health requirements, insurance and local laws required to enjoy Experiences;

6.1.5 complying with any house rules, safety instructions and requirements notified by the Host or Local Connection;

6.1.6 treating the Host or Local Connection, their property, other occupants and neighbours with respect;

6.1.7 leaving accommodation and associated facilities in the Experiences in the condition in which you found them, fair wear and tear excepted;

6.1.8 ensuring that any person you invite to, or allow to access, accommodation made available as part of an Experience complies with all requirements relating to the Experience which you are subject to; and

6.1.9 paying any amounts relating to the Experience.

6.2 You acknowledge that we are not responsible for the acts or omissions of any Host or Local Connection, or for the condition, safety, legality, suitability or availability of any accommodation or Experience, except to the extent that responsibility arises from our own breach of duty or breach of our Terms of Use.

7. Host responsibilities

7.1 If you are a Host, you must:

7.1.1 ensure that all information you provide about yourself, your accommodation and any Experience is true, accurate, complete and not misleading;

7.1.2 ensure that any Experience you make available is safe, clean, suitable, accurately described and available as represented;

7.1.3 comply with all applicable laws and regulations, including any planning, housing, short-term letting, licensing, tax, insurance, fire safety, health and safety, consumer protection and legal requirements;

7.1.4 obtain and maintain any permissions, consents, registrations, licences or approvals required to host Travellers or make Experiences available;

7.1.5 provide any information, instructions, warnings or rules required for the Traveller’s safe and lawful enjoyment of Experiences;

7.1.6 deal promptly and responsibly with any issue, complaint or dispute raised by a Traveller;

7.1.7 ensure that any person who assists you in providing an Experience complies with your obligations;

7.1.8 ensure that your own insurance arrangements are suitable to cover all potential liabilities arising from Experiences made available by you; and

7.1.9 make available Experiences only for your own account and not on behalf of third parties.

7.2 You acknowledge that we do not inspect, approve, certify or control your Experiences, and that you remain solely responsible for your acts and omissions as Host.

8. Local Connections responsibilities

8.1 If you are a Local Connection, you must:

8.1.1 ensure that all information you provide about yourself and any Experience is true, accurate, complete and not misleading;

8.1.2 ensure that any Experience you make available is safe, suitable, accurately described and available as represented;

8.1.3 comply with all applicable laws and regulations, including any insurance, health and safety, consumer protection and legal requirements;

8.1.4 obtain and maintain any permissions, consents, registrations, licences or approvals required to make Experiences available;

8.1.5 provide any information, instructions, warnings or rules required for the Traveller’s safe and lawful enjoyment of Experiences;

8.1.6 deal promptly and responsibly with any issue, complaint or dispute raised by a Traveller;

8.1.7 ensure that any person who assists you in providing an Experience complies with your obligations;

8.1.8 ensure that your own insurance arrangements are suitable to cover all potential liabilities arising from Experiences made available by you; and

8.1.9 make available Experiences only for your own account and not on behalf of third parties.

8.2 You acknowledge that we do not approve, certify or control your Experiences, and that you remain solely responsible for your acts and omissions as a Local Connection.

9. Financial arrangements between Members

9.1 Unless expressly stated otherwise in our Terms of Use or upon the Services, we are not responsible for payments, deposits, refunds, cancellation charges, damage claims or other financial arrangements agreed directly between Members.

9.2 If Members make payment arrangements between themselves outside the Services, they do so at their own risk.

9.3 We are not responsible for any loss arising from a Member’s failure to pay, refund, return a deposit, compensate for damage, attend, host, travel or otherwise perform a Member Contract, except to the extent that responsibility arises from our own breach of duty or breach of our Terms of Use.

10. Insurance

10.1 We do not provide travel insurance, personal accident insurance, medical insurance, property insurance, contents insurance, host insurance, public liability insurance or any other insurance cover for Members.

10.2 You are responsible for obtaining and maintaining any insurance that is appropriate for your use of the Services and your role as Host, Traveller or Local Connection.

10.3 You should check carefully whether any existing insurance policy covers your intended travel, hosting, accommodation sharing, property use, belongings, personal liability and any guests or third parties.

11. Claims

11.1 To the fullest extent permitted by law, we shall not be liable for, and you waive any claim against Her Travel Circle, its directors, officers, employees, contractors and representatives, for any claim, loss, damage, liability, cost or expense arising out of or in connection with:

11.1.1 any Member Contract;

11.1.2 any act or omission of another Member or third party;

11.1.3 any accommodation or Experience provided, arranged, cancelled, varied or refused by another Member;

11.1.4 any meeting, communication, interaction, stay, travel arrangement or dispute involving another Member;

11.1.5 any information, representation, statement, review, listing, profile or content provided by another Member;

11.1.6 any payment, refund, deposit, cancellation, damage claim or other financial arrangement between Members; or

11.1.7 your decision to host, travel, stay with, meet or otherwise interact with another Member.

11.2 Clause 10.1 does not apply to the extent that the relevant claim, loss, damage, liability, cost or expense is caused by our own breach of duty, breach of our Terms of Use, negligence, fraud or fraudulent misrepresentation, or by any matter for which liability cannot lawfully be excluded or restricted.

12. Limitation of our liability

12.1 Our liability to you is limited to losses which are a reasonably foreseeable consequence of our breach of our Terms of Use or breach of a duty owed by us to you.

12.2 We are not liable for any loss which is caused by:

12.2.1 the act or omission of a Member or third party;

12.2.2 any Contract Claims;

12.2.3 our failure to make enquiries or take precautions except where we have expressly agreed to make enquiries or take precautions;

12.2.4 your failure to obtain appropriate insurance;

12.2.5 inaccurate, incomplete or misleading information provided by Members;

12.2.6 circumstances beyond our reasonable control; or

12.2.7 your breach of this document or our Terms of Use.

12.3 If we breach these Terms, we are only responsible for losses that are a reasonably foreseeable result of that breach. We are not responsible for losses that are unexpected or too remote, including loss of profit, loss of business, loss of opportunity, loss of goodwill, business interruption, wasted expenditure, or the cost of replacing accommodation or travel arrangements.

12.4 Subject to clause 11.5, our total liability to you arising out of or in connection with the Services, this document and the Terms of Use shall not exceed the total amount paid by you to Her Travel Circle for use of the Services in the 12 months before the event giving rise to the claim.

12.5 Nothing in this Notice and Release limits or excludes our liability where it would be unlawful for us to do so, including for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any rights you have under the law that cannot be excluded or limited.

13. Responsibility for Losses Caused by You

13.1 You are responsible for any losses, costs, claims or expenses that we reasonably incur as a result of:

13.1.1 your breach of this Notice and Release or our Terms of Use;

13.1.2 anything you do or fail to do as a Host, Traveller or Local Connection;

13.1.3 any agreement between you and another Member;

13.1.4 any information, content, listing, communication or statement that you provide through the Services;

13.1.5 your failure to comply with applicable laws;

13.1.6 your failure to obtain any licence, permission, approval, consent, registration or insurance required for your activities;

13.1.7 a claim made by another Member or a third party arising from something you have done or failed to do; or

13.1.8 any damage, injury, loss or dispute caused by you or by anyone for whom you are legally responsible.

13.2 You are not responsible for any losses, costs, claims or expenses to the extent that they are caused by our breach of this Notice and Release or our Terms of Use, our negligence, our fraud or fraudulent misrepresentation, or any matter for which we cannot legally exclude or limit our liability.

14. Safety

14.1 You must use your own judgment when communicating with, meeting, hosting or staying with another Member. If you believe that there is an immediate risk to life, safety, property or security, you should contact the relevant emergency services or local authorities.

14.2 You should notify us promptly if you become aware of any conduct by a Member which may breach our Terms of Use or may endanger the rights, property or safety of any person so that we may take appropriate action against that Member in accordance with clause 13.3.

14.3 We may, but are not obliged to, investigate reports, suspend or terminate accounts, remove content, restrict access to the Services, or disclose information where we reasonably consider this necessary to protect the rights, property or safety of any person, comply with law, or enforce our Terms of Use.

14.4 We may use Stripe identity verification as one of the Services’ safety features. That verification is limited to the checks carried out by Stripe and should not be treated as a criminal-record check, background check, suitability assessment, guarantee of identity beyond the scope of those checks, or guarantee of any Member’s character, trustworthiness, conduct, safety or suitability. It is not an endorsement by us, and Members remain responsible for making their own checks and decisions before communicating with, meeting, hosting, visiting or otherwise interacting with another Member.

14.5 Reviews are provided by Members and reflect their own opinions, experiences and assessments only. We may moderate or remove reviews in accordance with our Terms, but we do not verify, endorse or guarantee the accuracy, completeness or fairness of any review. Reviews do not amount to a recommendation, endorsement, safety guarantee or suitability assessment by us, and you remain responsible for making your own checks and decisions before communicating with, meeting, hosting, visiting or otherwise interacting with another Member.

15. Package travel and regulated travel arrangements

15.1 Unless we expressly state otherwise in writing, Her Travel Circle does not organise, sell or supply package holidays or linked travel arrangements.

15.2 Nothing in this document is intended to exclude or restrict any obligation which may apply to us under the Package Travel and Linked Travel Arrangements Regulations 2018 or any equivalent, replacement or applicable travel law, where such obligation cannot lawfully be excluded or restricted.

15.3 You acknowledge that Member Contracts are arranged between Members and that, unless we expressly state otherwise in writing, the Host/Local Connection is responsible for the Experience made available by that Host/Local Connection.

16. Relationship with the Terms of Use

16.1 This document forms part of the terms which apply to your access to and use of the Services.

16.2 If there is any conflict between this document and the Terms of Use, the Terms of Use shall prevail, unless this document expressly states otherwise.

16.3 If any provision of this document is found to be invalid, unlawful or unenforceable, that provision shall be treated as modified to the minimum extent necessary to make it valid, lawful and enforceable. If that is not possible, the provision shall be treated as deleted. The remaining provisions shall continue in full force and effect.

17. Governing law and jurisdiction

17.1 This document and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Scotland.

17.2 You irrevocably agree that the courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this document or its subject matter or formation (including non-contractual disputes or claims).
