Please read these Terms of Service carefully before using Her Travel Circle. By accessing or using the platform, you agree to be bound by these Terms.
Our Terms of Use
We are Her Travel Circle Ltd, a company incorporated and registered in England with company number 17276090 whose registered office is at Carpenter Court 1 Maple Road, Bramhall, Stockport, Cheshire, United Kingdom, SK7 2DH ("Her Travel Circle", "we", "us" or "our"). These terms of use ("Terms of Use") apply to the use of our services (the "Services"). Our Services are those made available through our website located at https://www.hertravelcircle.com/
Where we refer to "you" or "your" we mean the person accessing the Services.
Please read these Terms of Use carefully as they set out terms and conditions which apply to the use of our Services. By using or registering to use our Services you agree to these Terms of Use. If you do not wish to agree to or abide by these Terms of Use, please cease using our Services immediately.

We may amend these Terms of Use from time to time. The version of these Terms of Use which shall apply to your use of our Services will be those current when you access our Services. If you have previously accessed our Services, please check these Terms of Use when you access our Services at a later date as they may have changed.
Information About Us
We are a membership platform, where those that have registered to use our Services (the “Members”) and paid the membership fee (the “Membership Fee”) may advertise or arrange experiences (the "Experiences") via the Services. Members who arrange Experiences are "Travellers", Members who advertise Experiences including accommodation are "Hosts", and Members who advertise Experiences not including accommodation are "Local Connections". Members can be a combination of Hosts, Travellers and/or Local Connections.
Experiences advertised and arranged between Members are to be provided free of charge, subject to any cost-sharing arrangements agreed:

strictly between Members;

in advance of the Experience taking place; and
-
without the involvement of Her Travel Circle.
The details of Hosts and Local Connections are disclosed as part of our Services where they advertise Experiences.
You may contact us using the following means. Our contact facilities specified below are monitored between 0900 and 1700 only, and only on days which are not weekends or public holidays in Scotland, United Kingdom.

We will endeavour to respond to you as soon as we are able. Please note that any response may not be immediate, and may take a number of days, as we may be required to investigate matters to allow a proper response to be made.
Our liability
As we are a membership platform and intermediary for communication between Members, any contracts between Members for the supply of Experiences (the "Member Contract(s)") are made directly between the relevant Members. We are not party to Member Contracts. Our obligation and liability shall be limited solely to facilitating introductions between Members via the Services.
All Experiences are made and conducted by Members. We do not supervise or control the provision of Experiences between Members, nor do we guarantee the provision of Experiences to Members.
We shall not be liable under or in relation to Member Contracts. Any and all claims for breach or non-performance, defective performance, cancellation or variation of a Member Contract ("Contract Claims") shall be made directly between the relevant Members, not with us.
If you are a Member arranging an Experience via our Services you agree that all Contract Claims shall be your sole responsibility, to attend promptly to any and all Contract Claims, and to use your reasonable endeavours to resolve any Contract Claims promptly.
Our liability to you is limited to the circumstances where we breach these Terms of Use.
We shall not be liable to you where we breach these Terms of Use due to a circumstance beyond our control, such as an act of God, failure of telecommunications providers, device malfunction, connectivity issues, war, civil unrest, act of government or other authority, or the occurrence of epidemics or pandemics.
We shall not be liable to you for any loss, costs, expenses or claims which are not reasonably foreseeable as arising as a consequence of our breach of these Terms of Use, including any misrepresentation as to the content of Experiences, loss or damage suffered during an Experience, wasted expenditure, costs and expenses arising from the cancellation or alteration of travel or accommodation or other plans, reduction in income, loss of profit, loss of opportunities, costs of acquiring replacement services, damage to goodwill, loss of contracts, business interruption, or such like.
Nothing in these Terms of Use excludes or limits our liability for death or personal injury caused by our negligence, our fraud or fraudulent misrepresentation, or any matter where our liability cannot be limited or excluded under applicable law.
Use of the Services
Any right accruing to you to access and/or use our Services is conditional upon your acceptance of and compliance with these Terms of Use.
Access to and use of the Services also requires you to adhere to our privacy policy (our "Privacy Policy"), our assumption of risk, liability notice and release (our "Notice and Release"), and our cookie policy located at https://www.hertravelcircle.com/cookie-policy (our "Cookie Policy") all of which are incorporated by reference into and shall form part of these Terms of Use.
You must be at least eighteen (18) years old to become a Member, and to access and use the Services.
We shall have the right exercisable in our sole discretion to restrict, suspend, limit or terminate use of or access to the Services where we believe a breach of these Terms of Use has occurred or is likely to occur or where we feel that any access or use may endanger the rights, property or safety of ourselves or others.
Our Services are made available using telecommunications systems and facilities which we do not control. Accordingly, we do not warrant, represent or guarantee that the Services will be available at any time or function correctly at all times.
Whilst we aim to ensure the Services will operate reliably; we do not guarantee that the Services will be uninterrupted or that the Services will be error-free or that the Services will meet any of your requirements. Whilst we will try to ensure that the Services operate reliably upon the current up-to-date devices and operating systems, we do not guarantee that they will, or that the Services will operate reliably upon any older devices or operating systems.
Communication via the Internet is not secure. Whilst we try to make sure that the Services are secure, we cannot guarantee the security of any information that you supply to us and therefore we cannot guarantee that it will remain confidential, for example during its transmission to us.
Please note that we use third party payment service providers to allow payments to be made via our Services for the Membership Fee. These payment service providers are PCI DSS compliant (see http://www.pcisecuritystandards.org), and we do not have access to your payment method information.
Please note that in the absence of negligence on our part, or any failure by us to comply with these Terms of Use, or breach by us of our duties under applicable laws, we will not be responsible or liable to you for any loss that you may suffer if a third party gains unauthorised access to any information (including any payment method information) that you submit to us (or our payment method service provider).
We recommend that you have in place up-to-date antivirus and personal firewall software when accessing and using our Services.
The Services may also be subject to limitations, delays and other problems inherent in the use of the internet and electronic communications. The Services may also be unavailable from time to time due to maintenance, upgrades, service failures or events outside our reasonable control. We do not warrant that the Services will be uninterrupted, error‑free, or free from faults or delays.
If you wish to use our Services in order to meet a particular deadline, we recommend that you access our Services in good time prior to that deadline.
Some features of the Services may require you to grant device permissions (such as camera, location, notifications). Declining permissions may limit certain functionality available via our Services.
We may require you to complete identity verification through our third-party verification provider, Stripe, or any replacement provider we may use from time to time. Any verification confirms only the checks carried out by that provider. It is not a criminal-record check, background check, guarantee of identity beyond the scope of those checks, guarantee of character, trustworthiness, conduct, safety or suitability, or endorsement by us. Verification does not remove the need for Members to carry out their own checks, make their own enquiries and decide whether to interact with, meet, contract with or otherwise deal with another Member. If you refuse to complete verification, cannot complete verification, provide inaccurate or misleading information, or attempt to avoid or interfere with the verification process, we may refuse, suspend, restrict or terminate your Account, membership and access to the Services, subject always to your statutory rights.
We do not carry out criminal-record checks, background checks, home inspections, in-person interviews, financial checks or suitability assessments on Members unless we expressly state otherwise in writing. Identity verification, member profiles, photographs, listings and reviews are limited sources of information only and do not mean that we have checked, approved or declared any person, property, location or arrangement to be safe, suitable, accurate or trustworthy.
Members are responsible for making their own decisions about whether to communicate with, meet, host, visit or otherwise interact with another Member. This includes communicating before any meeting or stay, checking compatibility, making their own enquiries, sharing plans with trusted contacts, protecting valuables, deciding whether to proceed, and leaving or ending an arrangement if they feel uncomfortable. We are not an emergency service, safeguarding service, dispute-response service or monitoring service. If a Member believes there is an immediate risk to their safety or the safety of another person, they should contact the police, emergency services or other appropriate authorities.
Accounts
To use the Services, you must create an account (your "Account"). Each Account is personal to the member who creates it. You must not create more than one Account, create an Account for another person, transfer your Account to another person, impersonate any person, or allow any other person to use your Account.
Any information you provide to us in creating or using your Account must be true, accurate, complete and correct. If any of that information changes after submission to us, you must update that information via your Account. We may request further information or evidence from you where we reasonably consider this necessary to verify your identity, assess your application, maintain the accuracy of your Account, or protect the proper operation of the Services.
You must ensure your account details are kept confidential. You are responsible for all activity conducted using your account details. Please let us know immediately if your account details become known to any other person.
Payments and Membership Fees
The Membership Fee will be displayed when creating your Account before you submit your payment. Please check the details of your membership and Membership Fee carefully before completing your purchase.
Memberships are purchased on an annual basis and, unless otherwise stated at the time of purchase, membership will continue for successive annual periods in accordance with clause 6.7.
As set out in clause 4.8, we use third-party payment service providers to process payments for Membership Fees. We do not accept cash payments.
Communication via the Internet is not secure. While we try to make sure that the Services are secure, we cannot guarantee the security of any information that you supply to us and therefore we cannot guarantee that it will remain confidential, for example during its transmission to us. Our third-party payment service providers are PCI DSS compliant (see http://www.pcisecuritystandards.org), and we do not have access to your payment information. In the absence of negligence on our part or any failure by us to comply with these Terms of Use, our Privacy Policy, our Notice and Release or our Cookie Policy or breach by us of our duties under applicable laws, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you submit to us or our payment service provider.
Your payment method may be charged at any time after you create your Account. Please ensure you have sufficient funds to meet any payment due to us.
All card payments are subject to authorisation by the relevant card issuer. Additional verification steps may be required by your card issuer or payment provider. All payments by credit card or debit card need to be authorised by the relevant card issuer. Extra steps such as the following may also apply:

Unless otherwise stated at the time of purchase, memberships will automatically renew at the end of each membership period for a further annual period.
The Membership Fee applicable to the renewal period will be the Membership Fee displayed on the Platform at the time of renewal or otherwise notified to you in advance of renewal.
We will notify you of any increase to the Membership Fee before the renewal payment is taken. The notice will be sent to the email address associated with your Account and will specify the revised Membership Fee and the date on which it will apply.
Renewal payments will be collected using your selected payment method on or shortly before the renewal date.
You may cancel automatic renewal at any time through your settings on the Services or by contacting us using the contact details provided in these Terms. Cancellation of automatic renewal will prevent future renewal charges but will not affect your access to the Services for the remainder of the then-current membership period.
Membership will not be activated, renewed or continue unless the applicable Membership Fee has been successfully paid.
If any payment is declined, reversed, refunded, recalled or otherwise not received by us after membership has been activated or renewed, we may suspend or terminate your membership and access to the Services until all outstanding amounts have been paid. We may also attempt to take payment again using your nominated payment method.
Unless stated otherwise, all Membership Fee payments are non-refundable. Any entitlement to a refund will be governed by these Terms and your statutory rights.
We may, at our discretion, provide a full or partial refund in exceptional circumstances. Any such refund is goodwill only and does not create any ongoing entitlement to a refund in similar circumstances.
From time to time, we may offer promotional discounts, vouchers or discount codes. Unless stated otherwise, discount codes may be used only once, have no cash value and may be amended or withdrawn at any time before use.
Where a lifetime membership is offered and purchased, the Membership Fee will be payable once only and the membership will not be subject to annual renewal charges. References in these Terms to renewal and renewal payments shall not apply to lifetime memberships unless expressly stated otherwise.
You may bring your membership to an end in accordance with these Terms and any cancellation rights available to you by applicable law. We will make arrangements to allow you to cancel renewal in a straightforward way and without requiring you to take steps which are not reasonably necessary to end the membership. Where you entered into your membership online, we will provide an online method of cancellation and will display instructions for cancellation on the Services You may also cancel by making a clear statement to us that you wish to bring your membership to an end. If you wish to cancel the renewal of your membership, you can do so through your account settings on the Her Travel Circle platform or by contacting us and making a clear request to cancel.
We will provide you with a cooling-off notice on the first day of the relevant renewal cooling-off period, or as soon as reasonably practicable after that day. The cooling-off notice will be provided separately from other information and will explain that your membership is continuing, that you have a right to cancel during the relevant cooling-off period, when that period begins and ends, how you may cancel, any circumstances in which that right may be lost, and the consequences of cancellation, including any refund to which you may be entitled and any reason why that refund may be reduced.
If you cancel your membership during a cooling-off period or otherwise exercise a statutory right to end your membership, we will confirm the cancellation and tell you when your membership will end. Where you are entitled to a refund, we will refund any amount due to you in accordance with applicable law. If you have already had access to the Services during the relevant period, any refund may be reduced where permitted by law to reflect the part of the membership or Services already supplied.
Member Obligations and Conduct
You agree and undertake to access and use the Services responsibly, lawfully and in good faith. You agree and undertake to interact with any other Members in a polite and courteous manner, respectfully, and with a view to ensuring that all Members enjoy a good experience when accessing and/or using the Services and/or supplying or enjoying Experiences.
You agree and undertake not to:

access or use the Services for any purpose prohibited by these Terms of Use or applicable law, or for any purpose which is or which we or any other person may reasonably consider is abusive, defamatory, discriminatory or harmful;

interfere with or disrupt the operation of the Services;
-
attempt to bypass or breach security measures applicable to the Services;
-
reproduce, copy, exploit or distribute any part of the Services or any material featured thereon without our permission;
-
use automated tools (including bots or scrapers) to access or interact with the Services;
-
use the Services for the laundering of proceeds of crime, to obscure the source or location of funds held by you, to avoid the payment of taxes, or for any other purpose which may be unlawful or improper;

use the Services for or on behalf of another person, for example to obscure the true user of our Services;
-
use the Services in conjunction with any payment method or facility which is not in your own name;
-
cause the operation of the Services to be jeopardised or impaired;
-
use the Services to access, or to attempt to access, the accounts of others or to penetrate or attempt to penetrate or breach anyone's security measures, computer software, hardware, electronic communication systems, or telecommunications systems;
-
use the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent, or to engage in "screen scraping," "database scraping," or any other activity with the purpose of obtaining lists of users or other data;
-
use the Services for any activity which adversely affects the ability of other people or systems to use the services or the internet generally, including, without limitation, flooding and hacking;
-
use the Services to impersonate any person or entity, use a false name, or use any name in relation to the Services that you are not authorised to use;
-
use or attempt to use the Services for any purposes that are fraudulent or which may reasonably be considered in pursuit of potentially conducting fraud;
-
use the Services, or any interaction arranged through or in connection with the Services, to harass, threaten, stalk, coerce, exploit, abuse, discriminate against, mislead or intimidate any person, or to engage in violence, theft, property damage, scams, misuse of private information, unwanted commercial solicitation or any other conduct which we may reasonably consider harmful, unsafe, unlawful or improper; or
-
act in a dangerous, unlawful, abusive or improper manner during any Experience or other arrangement made through or in connection with the Services, including conduct which may reasonably cause another member to feel unsafe, pressured, exploited or unable to end the interaction freely.
Further, in the conduct of your activities you must not mention or refer to the Services or use the Services in any way:

that causes nuisance;
-
in conjunction with any defamatory, offensive, or obscene material, or activities which would cause offence to others on grounds of race, religion, sexual orientation or otherwise;
-
in conjunction with any harm or harassment or attempt to harm or harass other people (including children) in any way;
-
in conjunction with any material that threatens or encourages bodily harm or the destruction of property, or the conduct of criminal offences or any activity which may give rise to civil liability;
-
in conjunction with material which infringes the copyright, trademark, patent, trade secret, privacy, right of publicity, or other intellectual property or rights of any other party;
-
in conjunction with any unsolicited advertising, promotional or marketing material; or
-
in conjunction with any false, misleading, deceptive, or fraudulent material or activities, including chain letters or pyramid schemes or the like.
Traveller Rights and Obligations
Members are solely responsible for their own acts or omissions while using the Services and when enjoying Experiences and for the acts and omissions of anyone they invite to join or participate in Experiences.
When enjoying Experiences, Members agree and undertake to:

leave accommodation and associated facilities in the Experiences in the condition in which they found them, fair wear and tear excepted;

act with integrity, treat other Members, other occupants, neighbours and all property with respect;
-
comply with applicable laws;
-
arrange their own travel, insurance and visas, where applicable; and
-
pay any amounts due to other Members as agreed between the relevant Members in relation to Experiences promptly.
Host Rights and Obligations
Members are solely responsible for their own acts or omissions while using the Services and advertising and/or supplying Experiences. Members are also responsible for the acts and omissions of anyone who assists them in providing Experiences.
When advertising and supplying Experiences, Members agree and undertake not to:

present Experiences in any way which is false, misleading, deceptive, or fraudulent; or
-
encourage Travellers to create third-party accounts, submit reviews, provide their contact details to circumvent the Services or take any other actions to circumvent the Services.
When advertising or supplying Experiences, Members agree and undertake to:
-
act with integrity, treat other Members with respect;
-
complying with all relevant insurance requirements; and
-
comply with applicable laws.
Local Connections Rights and Obligations
Members are solely responsible for their own acts or omissions while using the Services and advertising and/or supplying Experiences. Members are also responsible for the acts and omissions of anyone who assists them in providing Experiences.
When advertising and supplying Experiences, Members agree and undertake not to
-
present Experiences in any way which is false, misleading, deceptive, or fraudulent;
-
encourage Travellers to create third-party accounts, submit reviews, provide their contact details or take any other actions to circumvent the Services;
-
when acting as a Local Connection, offer accommodation to other Members unless also acting as a Host.
When advertising or supplying Experiences, Members agree and undertake to:

act with integrity, treat other Members with respect; and
-
comply with applicable laws.
Reviews
Reviews may only be left by Members who have had a genuine interaction with another Member through the Services.
Reviews must be truthful, fair and based on that interaction, and must not be retaliatory, discriminatory, abusive, misleading or otherwise improper.
We may moderate, edit, refuse to publish or remove any review where we consider it appropriate to do so.
Reviews are the opinions of Members only, not us, and we do not guarantee their accuracy.
A review is not an endorsement, recommendation or guarantee by us of any Member’s identity, character, trustworthiness, conduct, safety or suitability. Members must not manipulate, misuse or attempt to influence the review system, including by posting false reviews or arranging for others to do so.
Security
We may apply security measures and restrictions to our Services. You agree not to tamper with or try to circumvent, avoid or negate such security measures or restrictions, or ask or help any other person to do so, including by the submission of false information, or using means which obscure the identity of the devices or persons visiting our Services, such as using VPN services or the TOR browsers.
Our Services contain important notices (including intellectual property notices) including those contained in any digital rights or other security technology embedded or contained within the Services. You must not tamper with or attempt to remove any of these notices.
Intellectual Property
When you submit material to us via our Services you grant us the right to use that material in connection with the operation of the Services. This includes storing that material and for marketing purposes. We may permit other people to do this on our behalf. These rights shall be free and irrevocable and shall exist perpetually. You agree that we do not have to identify you as the author of that material, and that you shall have no right to object to our treatment of that material. This does not affect your rights under laws relating to personal data. However, where any personal data is contained in that material, you consent, and must have any other identified person's consent, to submit that material to us and to allow us to use that material as mentioned above.
Our Services and all intellectual property in them are owned by us or our licensors or both (as applicable). Intellectual property includes the copyright in our Services and their code, our trademarks, and those of other people, design rights, for example in our user interfaces, database rights, and all other intellectual property or rights of any kind, and whether or not they are registered or unregistered, even if it were possible to register them (and we have not progressed any such registration).
We and our licensors reserve all of our and their rights. This means, for example, that we (and they) remain owners of the intellectual property and remain free to use it as we (and they) see fit.
You have the right to access and use our Services subject always to these Terms of Use. Nothing in these Terms of Use or otherwise grants you any other right, title or interest in or to the Services.

If you think any part of our Services, or anything available through our Services, infringes your rights, please contact us using the means set out above. When contacting us please provide:

your address, telephone number, and email address;

a description of the rights that you claim have been infringed;

a description of the alleged infringing activity;

a statement by you that you have a good faith belief that infringing activity is not authorised by you, the rights owner, its agent, or the law; and
-
a statement by you to the best of your knowledge and belief that the information is accurate and that you are the rights owner or authorised to act on the rights owner's behalf.
Our rights
Where we become aware or suspect that you have breached or may have breached these Terms of Use, we may at our discretion and without notice to you terminate, suspend or limit your use of the Services, without any refund being due to you subject to your statutory rights.
We may also restrict operation of our Services at any time for any reason, for example to conduct maintenance work or to monitor or investigate the operation of our Services.
We may monitor use of our Services to ensure their proper operation, so as to evaluate improvements to our Services, or to detect and investigate whether there has been a breach of our Terms of Use.
Where we do this, this does not negate your obligations to us or to other Members, nor does it affect any rights or obligations under any Member Contract. We may also disclose information concerning you and your activities to any other person where we reasonably believe such disclosure is warranted to protect the rights, property or safety of any person.
If your membership has been refused, suspended or terminated, you must not create another Account or seek to access the Services again without our prior written consent.
If you become aware of any breach of these Terms of Use you must notify us promptly at admin@hertravelcircle.com.
We will exercise our rights under this clause reasonably, consistently and in accordance with applicable law.
Third Party Content, Links and Integrations
The Services may contain links to third‑party websites, platforms, apps or content or integrations with platforms such as social media, location or communication services ("Third Party Services"). Any such links or integrations are provided for your convenience only. Your use of these Third-Party Services is subject to their own terms and conditions and privacy policies. We are not responsible for their operation, content, accuracy or conduct, although we may earn commission from them. Accessing Third Party Services is at your own risk.
International use
The Services may be accessed by Members in different countries. You are responsible for ensuring that your use of the Services, and any Experience you arrange, host or participate in, complies with all laws and regulations applicable to you.
We do not represent, warrant or guarantee that the Services, any Member Contract, any accommodation or any Experience will comply with the laws of any particular country, region or location outside the United Kingdom.
General
If you have any complaint or concern regarding the Services, please contact our customer support team at admin@hertravelcircle.com. We will endeavour to resolve your concerns promptly.
You have certain legal rights when using the Services, as a consumer. These are also known as "statutory rights". For more information upon these rights please consult your local Citizens Advice Bureau or an appropriately qualified and experienced lawyer.
If you want to take court proceedings, the courts of Scotland will have jurisdiction in relation to these Terms of Use, and Scots law will apply to these Terms of Use.
Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. You can submit a complaint to Her Travel Circle through their website at https://www.hertravelcircle.com/. Her Travel Circle does not charge you for making a complaint and] [[if OR If] you are not satisfied with the outcome you can still go to court.
Only us and Members may enforce these Terms of Use. Otherwise, no third party has the right to enforce any provision of these Terms of Use.
If any provision of these Terms of Use is determined to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.
